These Terms of Use (the “Terms”) set forth the conditions for using the iOS application “FormUp” (the “App”) provided by the individual developer Masayoshi Suzuki (the “Developer”), as well as any related services provided by the Developer (collectively, the “Service”). All users (each, a “User”) are deemed to have agreed to all provisions of these Terms and the Apple Standard End-User License Agreement (the “Apple Standard EULA”) by downloading, installing, or using the App. If the User is a minor, the User must obtain the consent of a legal guardian before using the App. However, AI Form Analysis is available only to Users who are at least 18 years old.
The following definitions apply to these Terms:
(1) Device: An iPhone that meets the requirements listed under “Supported Devices” on the Support page.
(2) Pose Analysis: On-device processing that uses Google MediaPipe to detect and visualize skeletal lines, joint angles, joint-point trajectories, and related information from a video or camera feed.
(3) AI Form Analysis: An optional feature initiated by the User that sends one video, or two videos selected for comparison, together with optional input information to an external generative AI service and generates feedback about the User’s form.
(4) AI Analysis Results: Feedback text and other output information generated by an external generative AI service through AI Form Analysis and received by the App.
(5) Core Features: (i) Pose Analysis; (ii) Comparison, including side-by-side or overlaid playback and frame-by-frame viewing of videos processed with Pose Analysis; (iii) Capture & Instant Analysis, including skeletal overlays while recording with the App’s camera and Pose Analysis after recording; and (iv) My Data, including recording, editing, and deleting practice logs, activity statistics and visualizations, and retrieval of weather information for practice sessions.
(6) Generated Content: Videos, images, numerical data, and other outputs created through on-device analysis or processing of User Content by the App. AI Analysis Results are not Generated Content.
(7) Viewing Features: Features available regardless of subscription status, including playback and pause of videos processed with Pose Analysis, toggling skeletal lines and angles, on-device storage, recording, editing, deleting, and searching practice logs, viewing streak and total analyzed-video cards, manual weather selection, and other features displayed as available in the App.
(8) Apple Account: The authentication account provided by Apple Inc. (formerly “Apple ID”). In-app purchases are billed to this account.
The App provides Pose Analysis of sports movements, comparison of processed videos, skeletal overlays during recording, practice-record management, and optional AI Form Analysis initiated by the User.
Video processing for Pose Analysis, Comparison, and skeletal overlays during recording is completed on the Device. Videos are not sent to an external AI service for these features. Pose Analysis and Comparison generally operate offline when the required videos are available on the Device.
Before sending a video for AI Form Analysis, the App may resize or re-encode the selected video, composite skeletal lines, joint angles, or related information onto a video previously processed with Pose Analysis, or combine two comparison videos into one, all on the Device. The audio track is removed before transmission and is not sent. The App encrypts and sends the processed video, any sport name or issue the User optionally enters, the response-language setting, and instructions required for analysis to an external generative AI service. Temporary files created for transmission are deleted from the Device after processing is completed.
AI Analysis Results are stored on the Device after receipt. Servers and databases managed by the Developer do not receive or store videos used for AI Form Analysis, the body of the User’s input, or the body of AI Analysis Results. The external generative AI service provider may nevertheless process and retain this information for abuse monitoring, service safety, and other applicable purposes under its published terms and policies. The App’s Privacy Policy and AI Analysis Consent govern the specific information transmitted, the processors involved, and how the information is stored, retained, and disclosed.
AI Form Analysis requires an internet connection, Sign in with Apple, acceptance of the AI-specific consent shown in the App, an active eligible subscription, remaining usage quota, an age of at least 18 years, use from a region supported by the external generative AI service, and any other conditions displayed in the App. Users must comply with the video-duration, file-size, format, and other technical limits displayed in the App.
Practice logs entered in My Data and statistics calculated from them are stored on the Device. When automatic weather retrieval is used, the App connects to Apple WeatherKit based on location information. The Privacy Policy governs the handling of app-usage data, authentication, purchase validation, usage-quota management, and other data.
The App supports Japanese, English, Italian, French, German, Chinese (Simplified and Traditional (Hong Kong)), Korean, and Spanish (Mexico).
